New Delhi: The Allahabad High Court on Friday declared UP Board of Madarsa Education Act, 2004 as "unconstitutional" and said it violates principle of secularism. The court found that the act breached the secularism principle and directed the state to integrate the affected students into the regular education system. The verdict was delivered by Justices Vivek Chaudhary and Subhash Vidyarthi from the Lucknow division, in response to a legal challenge by an individual named Anshuman Singh Rathore.
Rathore's petition contested the legal validity of the UP Madarsa Board and criticized the administration of madarsas by the Minority Welfare department, implicating both the central and state governments.
